Refunds, Privacy Policy, and Terms of Service Policies


Returns or Refunds are not available for personalized or custom made items (generally all of our embroidered, or hand stamped jewelry, and other custom items). In the event of an error on our part in spelling or other specifications, an exchange or refund will be processed when the original item is returned in new condition within 10 business days.

For non custom or personalized items:
Our policy lasts 7 days from receipt of purchase. If 7 days have gone by since your purchase was delivered, unfortunately we can’t offer you a refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Several types of goods are exempt from being returned. Perishable goods such as food, flowers, newspapers or magazines cannot be returned. We also do not accept products that are intimate or sanitary goods, hazardous materials, or flammable liquids or gases.

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted (if applicable)
Book with obvious signs of use
CD, DVD, VHS tape, software, video game, cassette tape, or vinyl record that has been opened
Any item not in its original condition, is damaged or missing parts for reasons not due to our error
Any item that is returned more than 30 days after delivery

Refunds (if applicable)
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.
If you’ve done all of this and you still have not received your refund yet, please contact us at jennifernoeldesigns@hotmail.com.

Sale items (if applicable)
Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

Exchanges (if applicable)
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at jennifernoeldesigns@hotmail.com and send your item to: P.O. Box 1071 Discovery Bay California US 94505.

Gifts
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

_shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits
_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.
cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.
_secure_session_id, unique token, sessional
storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

It’s also here to protects the rights of my customers and inform you about possible use of your data, when you interact with this store. • Accounting Services through GoDaddy Accounting Software
Legal basis for a disclosure of this data is the company’s lawful obligation, namely accounting and record keeping for tax purposes.
• Email Marketing: MailChimp
Legal basis for a disclosure of this data is the user’s consent – if you sign up for any email subscription, you will be asked to agree for the use of your data. Sign up is not necessary to place an order. Purchases in any Jennifer Noel Designs LLC and subsidiaries shops do not result in email marketing opt in.
• Payment processing: PayPal, Etsy Direct Checkout, Shopify Payments, Square Payments
Legal basis for a disclosure of this data is the Sales Agreement between the Seller and Buyer. I will only disclose data that is necessary for the purposes of payment processing, refunds or complaints and queries related to these payments. If you’re unsure about how the data is stored by these payment services, I encourage you to visit their websites at links above an read more about the measures they take to protect your personal data.
• Additionally, I may disclose some of your personal data to insurers and professional advisers, as long as it’s necessary, for example to manage risks, receive professional business advice or proceed with legal claims in or outside court.

Any data shared with third party is forwarded using encrypted internet connection (SSL). The service providers working with Jennifer Noel Designs LLS are GDPR compliant and belong to the Security Shield program. Physical copies of your personal data (for example shipping labels, invoices) are stored in my studio in California USA and destroyed as soon as no longer required.

The information I keep or delete:
Your personal data is not kept indefinitely, it's only stored as long as necessary for legal reasons or for order fulfillment. USA law requires me to store any transactional information at least until the end of the calendar year plus 5 full years.
In some cases it's not possible to specify how long your data will be kept. The period of retention will be set based on the company’s legal obligations and legitimate interests – such as maintenance of this shop.
I may also keep your personal records longer than specified, if it’s to protect your vital interests or the vital interests of another natural person.

Your rights:
You have the right to review and correct your personal data.
The admin of your personal data on Etsy is Etsy itself. If you'd like to remove your personal data from Etsy, please contact support. If you would like to remove your data from Jennifernoeldesigns.com please contact info@jennifernoeldesigns.com
You can also request that I delete all records of your personal data stored by JenniferNoelDesigns LLC. I’m happy to honor the request and will do my best to erase your information, whenever possible, however there are certain situations, when I’m not able to delete all of your information, due to legal obligations. For example, if you have previously placed orders in any of Jennifer Noel Designs LLS and subsidiaries shops, I may be required to keep your personal data for tax purposes.
